Being unaware hostilities between Great Britain and America had ceased, Constitution discovered two ships to leeward of her and closed to investigate. Suspecting they were British warships, she gave chase and soon overhauled them. After hoisting her colours the two British ships hoisted the British ensigns and battle commenced.

As the evening light quickly faded so did the intense fire of the British ships. Both ships being "line astern" and to leeward of the American were soon enveloped in smoke and could not see their enemy. Constitution backed her sails and made sternway until she was opposite the rear most and now isolated British ship. When the smoke cleared the intense battle recommenced but it was not long before the smaller HM Ship Cyane, struck her colours. Constitution, then made for HMS Levant which had headed away for repairs. It was getting quite dark when she returned, but again, was out gunned by the much larger American warship; firing a gun to leeward, HMS Levant struck her colours.
